Homemaker wife does not ‘sit idle’, unjust to disregard her labour: Justice Swarana Kanta Sharma

Rejecting the long-held “idle wife” stereotype, the Delhi High Court has observed that a homemaker’s work is far from passive. The court stated that the labour performed within a household enables the earning spouse to function effectively, and ignoring this contribution while deciding maintenance would be both unrealistic and unjust.


In its February 16 judgment, the court noted that labelling a non-earning spouse as “idle” reflects a fundamental misunderstanding of domestic work. It remarked that while it may be easy to equate non-employment with idleness, recognising the labour required to sustain a household demands far greater sensitivity.


“A homemaker does not sit idle; she performs labour that supports the earning spouse,” the court said, adding that disregarding this role in maintenance proceedings would be unfair.


The bench further clarified that it cannot accept any view that treats a wife’s non-employment as idleness or deliberate dependence on her husband.


These observations were made while hearing a case concerning maintenance for an estranged wife under the Protection of Women from Domestic Violence Act.
